OpenAI won a major legal victory after a federal judge dismissed a trade-secret lawsuit filed by xAI, Elon Musk’s AI company. U.S. District Judge Rita Lin ruled that xAI failed to show that OpenAI encouraged or knowingly received confidential information from former xAI employees. The case was dismissed with prejudice, meaning it cannot be refiled, according to a report by Reuters.
xAI sued OpenAI in September 2025, accusing the ChatGPT maker of recruiting former xAI employees to obtain trade secrets related to Grok, xAI’s chatbot. The lawsuit claimed OpenAI sought an unfair advantage in the AI race by gaining access to confidential information, source code and technical knowledge developed at xAI.
The amended complaint centered on former xAI senior engineer Xuechen Li. xAI alleged that Li disclosed proprietary information during recruitment discussions with OpenAI. The company argued that OpenAI was interested in information related to Grok’s development and advanced AI-training techniques.

Judge Lin said xAI failed to provide evidence that OpenAI induced Li to reveal trade secrets or that OpenAI employees knew any confidential information had been disclosed. She noted that asking job candidates about their previous work experience is a routine part of hiring and does not automatically imply wrongdoing. The judge concluded that continuing the case would be “futile,” leading to its dismissal with prejudice.
OpenAI denied the allegations and said Li never worked for the company. The company stated that it neither wanted nor possessed xAI trade secrets. Following the ruling, OpenAI described the lawsuit as another part of Musk’s ongoing campaign against the company.
While OpenAI has been cleared in this case, xAI continues to pursue separate legal action against Li. Li has denied wrongdoing in that case. Earlier proceedings included efforts by xAI to prevent him from sharing information related to Grok and other AI technologies.

The ruling marks Musk’s second major courtroom loss against OpenAI in less than a month. In May, a federal judge rejected Musk’s $150 billion lawsuit accusing OpenAI and CEO Sam Altman of abandoning the organization’s original nonprofit mission.
The lawsuit reflects the intensifying competition among leading AI companies as they race to develop increasingly powerful models. Concerns over employee mobility, intellectual property and trade-secret protection have become more prominent as firms compete for talent and technology. OpenAI and xAI have emerged as key rivals in the rapidly growing AI sector.
The dismissal removes another legal challenge facing OpenAI as it expands its business and pursues future growth plans.
