A Delhi court on Tuesday proclaimed Uber cab driver Shiv Kumar Yadav guilty of raping and endangering the life of a 25-year-old woman in his taxi on December 5 last year. The argument on the quantum of punishment will be heard on October 23.
Additional Sessions Judge Kaveri Baweja convicted Yadav (32) under the Indian Penal Code (IPC) sections related to rape, endangering a woman’s life while raping her, abducting with intent to compel her for marriage, criminally intimidating and causing hurt.
“Shiv Kumar Yadav is convicted of all charges (framed against him). To come up for arguments on quantum of sentence on October 23,†the judge said. He may face life imprisonment for the charges.
According to the prosecution, Yadav raped the survivor, a finance executive working in Gurgaon, when she was returning to her house in Inderlok on the night of December 5, 2014. The prosecution had produced 28 witnesses in support of its argument.
Yadav was arrested on December 7 from Mathura.
Special public prosecutor Atul Shrivastava told media that there was sufficient evidence on record to hold Yadav guilty and that all prosecution witnesses supported the case against him.
Additional Sessions Judge Kaveri Baweja had on October 7 reserved the verdict after concluding hearing of the final arguments from both the sides in the case.
The lawyer of the accused, Dharmendra Kumar Mishra said, “Court has convicted him of all the charges for which he has been charged. Accused Shiv Kumar Yadav has been convicted under various sections like 366, 323.”
Earlier, the Supreme Court had revoked the order of the Delhi High Court allowing the accused to re-examine 13 prosecution witnesses, including the victim.
“Oral evidence, medical evidence and scientific evidence was considered during the judgement. I would be asking for maximum punishment that is under section 376 (2)(M) life imprisonment for the accused,” Special public prosecutor Atul Shrivastava said.
Yadav was present in the courtroom with his wife and parents.
It is learned that five cases of similar nature had been registered against him, after the arrest of Yadav in relation to this case.
