The U.S. Department of Homeland Security (DHS) is reportedly updating H-1B visa requirements. It issued a final rule on Dec. 18, 2024, which follows up on a 2023 proposed rule that sought to “modernize” the H-1B program.
Reportedly, the rule revises the definition of “specialty occupation” to clarify that while sponsoring employers may accept a range of qualifying degree fields when considering candidates for such occupations, the fields must be directly related to a job’s duties in order to meet the specialty occupation requirement.
Other changes will include new definitions for nonprofit and government research organizations, which would allow more petitions in these categories to be exempt from the visa cap. Another update explains the requirements for visa petitioners. The rule will take effect on January 17.

However, not everyone is on board the H-1B hype train like Elon Musk and now President-elect Donald Trump. Senator Bernie Sanders (I-Vt.) has gone after Musk, for his defense of the H-1B visa program.
Sanders criticized the wealthy tech entrepreneur’s elevation of the foreign visa system, arguing that it further enriches a handful of the nation’s richest people.
“Elon Musk is wrong,” the self-proclaimed Democratic socialist wrote in a statement, which he promoted on Musk’s platform, X.
“The main function of the H-1B visa program is not to hire ‘the best and the brightest,’ but rather to replace good-paying American jobs with low-wage indentured servants from abroad,” he wrote. “The cheaper the labor they hire, the more money the billionaires make.”
What is the H-1B visa?
The H-1B visa is a non-immigrant visa that allows U.S. employers to hire foreign workers in specialty occupations that require specialized knowledge and a bachelor’s degree or higher in a specific field. Common fields include technology, engineering, healthcare, and business. This visa allows workers to stay in the U.S. for an initial period of three years, with the possibility of extending it for another three years, depending on the employer and the situation.
There is an annual cap on the number of H-1B visas granted, but certain employers, such as nonprofit research organizations, higher education institutions, and government research organizations, are exempt from this cap.

The application process involves submitting a petition to the U.S. Citizenship and Immigration Services (USCIS), and the visa is awarded through a lottery system due to high demand. H-1B workers can also apply for permanent residency if eligible.
Many Indian workers are employed in major U.S. tech companies, gaining valuable experience. Additionally, the visa allows for potential extensions and the possibility of transitioning to permanent residency or Green Card. The H-1B also allows Indian workers to bring their dependents such as spouses and children, who can stay in the U.S. and may work or study under certain conditions, offering a better quality of life.

If this will give me a chance to first of all to qualify am a single parent with guardianship over my son l am 64 years of age and he is 42 years of age the government housing programs take too long and if this can prioritize me being a Senior Citizen and allowing both of our incomes to qualify that would really be a blessing because l have been renting and l would like to own one of the American Dreams for these government programs are backwards put me in a home then l can go to the classes!32
